Terms of Service

Effective September 18, 2026.

These Terms of Service ("Terms") govern your use of the Puffy Couch website (the "Site") and every purchase you make through it. Puffy Couch is operated by Madame Chervilo LLC, a Massachusetts limited liability company ("Puffy Couch", "we", "us"). By using the Site or placing an order you agree to these Terms, our Shipping Policy, our Returns & Refund Policy and our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. We currently sell and ship within the United States only.

2. Products

We sell boneless, foam-filled sofas that ship vacuum-compressed. Product photos, colors and dimensions are provided by our suppliers and are as accurate as we can make them. Colors may look slightly different on your screen than in person, and foam products can vary by a small margin (typically 1–3 inches) from the listed dimensions. Slight variation in color, texture or size is normal and is not a defect.

3. Orders and acceptance

Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may refuse or cancel any order before shipment, for example when a product is unavailable, when we suspect fraud, or when there is a pricing or listing error. If we cancel an order you have paid for, we refund you in full.

4. Prices and payment

Prices are shown in US dollars and may change at any time without notice. The price that applies to your order is the price shown at checkout when you place it. Taxes and any shipping charges are calculated and shown at checkout. If a product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the order and refund you. Payment is processed securely by Shopify Payments and its partners; we never see or store your full card details.

A "compare at" or crossed-out price shows the regular list price for the product. The price you pay is always the current price displayed next to it.

5. Discount codes

Discount codes are valid only as described on the Site, cannot be combined unless stated, have no cash value, and may be withdrawn at any time. Codes intended for new customers can be used once per customer and per household.

6. Shipping

Shipping is governed by our Shipping Policy. Delivery times are estimates, not guarantees. Risk of loss passes to you when the carrier delivers the package to the address you provided.

7. Returns, damage and refunds

All sales are final. Because our products are compressed foam sofas without hard frames or loose parts, we do not accept returns for change of mind, fit, color preference or comfort. Items that arrive with visible damage, a visible defect, or that are not the item you ordered are covered under our Returns & Refund Policy, which forms part of these Terms. You must accept that policy before adding an item to your cart.

8. Your account

You may create an account to track orders. You are responsible for keeping your login secure and for everything done through your account. We may close accounts used for fraud, abuse or repeated chargebacks.

9. Intellectual property

The Puffy Couch name, logo, Site design and original text are ours. Product photos are used under license from our suppliers. You may not copy, scrape or reuse Site content for commercial purposes without our written permission.

10. Warranty disclaimer

Except for the damage coverage described in our Returns & Refund Policy, products are provided "as is". To the fullest extent permitted by law we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so this may not fully apply to you.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages, including loss of use or damage to floors, walls or other property caused by moving or using a product. Nothing in these Terms limits liability that cannot be limited by law.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Before starting any legal action, you agree to contact us at puffycouch.info@gmail.com and give us 30 days to resolve the issue. Any dispute that cannot be resolved will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction. Claims must be brought individually, not as part of a class action, where the law allows.
