Terms of service

Effective September 23, 2026 for new orders. The terms in effect when an earlier order was placed continue to apply to that order.

These Terms of Service ("Terms") govern your use of the Puffy Couch website (the "Site") and every purchase you make through it. Puffy Couch is operated by Madame Chervilo LLC, a Massachusetts limited liability company ("Puffy Couch", "we", "us"). By using the Site or placing an order you agree to these Terms, our Shipping Policy, our Refund Policy and our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. We ship to the 48 contiguous United States and Washington, DC, subject to the exclusions in our Shipping Policy.

2. Products

We sell boneless, foam-filled sofas that ship vacuum-compressed. Product photos, colors and dimensions are provided by our suppliers and are as accurate as we can make them. Screen settings can affect color appearance. Any stated dimensions and tolerances must be read from the individual product listing; there is no blanket size tolerance for all products. These observations do not exclude remedies for a defective product or an item that does not match its description.

3. Orders and acceptance

Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may refuse or cancel any order before shipment, for example when a product is unavailable, when we suspect fraud, or when there is a pricing or listing error. If we cancel an order you have paid for, we refund you in full.

4. Prices and payment

Prices are shown in US dollars and may change at any time without notice. The price that applies to your order is the price shown at checkout when you place it. Standard shipping is free within our stated delivery area; any applicable taxes are calculated and shown at checkout. If a product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the order and refund you. Payment is processed securely by Shopify Payments and its partners; we never see or store your full card details.

5. Discount codes

Discount codes are valid only as described on the Site, cannot be combined unless stated, have no cash value, and may be withdrawn at any time. Codes intended for new customers can be used once per customer and per household.

6. Shipping

Shipping is governed by our Shipping Policy: handling is normally 1-3 business days and transit is normally 3-13 business days, for an estimated total of 4-16 business days. The policy explains excluded destinations, shipment delays, cancellation choices, and lost or damaged shipments. Delivery estimates do not remove your rights when we cannot ship on time or an order is not received.

7. Returns, damage and refunds

We do not offer change-of-mind or preference returns or exchanges. For visible delivery damage, visible defects or a wrong item, email us within 15 calendar days after delivery of the affected item. This is a request deadline, not a requirement for the item to reach us within 15 days. We pay necessary return shipping for approved damaged, defective or wrong-item returns and charge no restocking fee. Later-discovered defects and mandatory consumer rights are not limited to this reporting period. Our Refund Policy explains the full process, refund timing and email cancellation requests.

8. Your account

You may create an account to track orders. You are responsible for keeping your login secure and for everything done through your account. We may restrict accounts used for fraud or abuse. Nothing in these Terms prevents you from exercising a legitimate payment-dispute or consumer-protection right.

9. Intellectual property

The Puffy Couch name, logo, Site design and original text are ours. Product photos are used under license from our suppliers. You may not copy, scrape or reuse Site content for commercial purposes without our written permission.

10. Product warranties and consumer rights

Nothing in these Terms or our policies excludes or limits applicable implied warranties, including merchantability and fitness for a particular purpose, or any mandatory consumer remedy. Any additional written product warranty will be identified in the applicable product listing or warranty document. The 15-day visible-damage reporting process does not waive rights for later-discovered defects or other rights provided by law. Email us if a product appears defective or does not match its description.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages, including loss of use or damage to floors, walls or other property caused by moving or using a product. Nothing in these Terms limits liability that cannot be limited by law.

12. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. We encourage you to email puffycouch.info@gmail.com so we can try to resolve a concern. This does not require you to delay a claim or waive a legal deadline or remedy. Any dispute that cannot be resolved will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction. This section does not displace mandatory protections or court access available under applicable consumer law.

13. Changes

We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order.
